Can we sell before the divorce is final?

Often, yes. If both owners sign, along with dower consent where it applies, the home can be sold during a separation. Your lawyers will confirm what's needed.

Do we both have to agree to sell?

If you both own the home, both owners sign the listing and the sale. If you're married and the home is in one spouse's name, the other spouse usually has to give dower consent. If you don't agree, talk to your family lawyer before taking any steps.

Does a separation agreement take me off the mortgage?

No. A separation agreement doesn't take someone off the mortgage. A refinance or a sale does.

Who holds the money from the sale?

Often a lawyer holds the sale funds in trust until the property division is settled. Confirm this with your lawyers early.

Will buyers know we're separating?
